In a claim for use of excessive force by police officers in the course of executing a search warrant, grant of summary judgment in favor of defendant-officers is reversed in part, affirmed in part, and remanded where: 1) defendant-officer did not violate plaintiff's constitutional rights in handcuffing him because the handcuffs were removed when defendant learned of plaintiff's complaints; 2) defendant-officer is not entitled to qualified immunity from plaintiff's claim that defendant used excessive force in cramming plaintiff into the back of a police vehicle. 6th. Cir. Decisions for Week of Jul 14-18, 2008 (Ky - 2 Pub, 2 NPO) posted at www.SixthCircuitCases.com.

For those who do not know, this link is to a separate legal blog that posts weekly tables of decisions (published and nonpublished) from the United States Court of Appeals for the Sixth Circuit, plus occasional news and other official postings from their web site.

The Kentucky decisions are "highlighted" in an off-color background for quick identification and the substance of the decision posted (by substance I am referring to the opening paragraphs from the decision).

Most of the civil decisions have a short synopsis; the criminal, prisoner, immigration, and bankruptcy decisions are not digested but are listed.

Nonpublished decisions are not digested but just listed.

All cases are from the same week and have links to the full text of the decision.

Sixth Circuit Cases' goal is always to post the links for the week within the week so you have at least an advance sheet of the cases, but try for something extra for the Kentucky decisions and the civil decisions.

6th Circuit: ECF Rules Amendment UPDates from Web Site

I just found the following information regarding electronic case filing at the Sixth Circuit which began effectively June 1, 2008.  Here's the info:

Effective June 1, 2008: the U.S. Court of Appeals for the Sixth Circuit has implemented the ECF system for the electronic filing of court documents. ECF Document Filing

The court of appeals has adopted amendments to the 6 Cir. Rules and Internal Operating Procedures. The amendments have taken effect as of June 1, 2008. More Information

Opportunity for Comment on Amendments

The amendments to the Sixth Circuit Rules and Internal Operating Procedures noted above were made in advance of the period for comment required by 6 Cir. R. 47, due to the immediate need for their implementation. The court is interested in receiving comments from the bar, and anyone interested in doing so may submit them via e-mail to: ca06-clerk_court@ca6.uscourts.gov. 

All comments are to be submitted by Monday, September 1, 2008.

Notice: Re: Electronic Case Filing (ECF)

Effective June 1, 2008 the U.S. Court of Appeals for the Sixth Circuit has implemented the ECF system for the electronic filing of court documents. A special registration form which must be completed for that purpose can be accessed at this link. Registration Information
