DIET DRUG TRIAL: New charges may be added to list when retried

COVINGTON . A federal judge has set an October trial date for two Lexington-area lawyers accused of pocketing millions of dollars that should have gone to their former clients in a diet-drug settlement.
But an Oct. 14 start for the second criminal trial of William Gallion and Shirley Cunningham Jr. is unlikely. Federal prosecutors said in court Wednesday that they may seek additional charges against the two men, and defense lawyers told U.S. District Judge Danny Reeves that an October trial date will likely conflict with their schedules.

COMAIR CRASH: Judge Orders Parties to Seriously Attempt to Settle

Herald Leader story:

Families who haven't settled lawsuits over a Kentucky plane crash that killed 49 people were ordered Thursday to meet with ComAir officials in a last-ditch effort to avoid trial.

Judge Karl Forester scheduled most of the settlement conferences for the next two weeks and said family members representing the estate of each victim and top airline decision-makers should attend.

A federal judge has set Oct. 14 as the start of a retrial for two Lexington lawyers charged in a diet drug settlement case. The Lexington Herald-Leader reported the retrial will likely be pushed back after federal prosecutors said at a court hearing Wednesday that they might seek additional charges against attorneys William Gallion and Shirley Cunningham Jr.

DIET DRUG TRIAL: Deadlocked Jury and New Trial to be set for Gallion and Cunninham; Mills acquitted

Picture_15 U.S District Court Judge William Bertlesman has declared a mistrial, as jurors deadlock on two lawyers charged with diet-drug settlement fraud. The jury had been considering the fate of suspended lawyers William Gallion and Shirley Cunningham Jr., who are accused of defrauding their clients out of $65 million Fen-Phen settlement.  The third attorney defendant Melbourne Mills was acquitted and released.

Mistrial declared after diet-drug jury deadlocks

COVINGTON, Ky. -- After 52 hours of deliberation over eight days, a federal jury yesterday declared it was hopelessly deadlocked in deciding whether attorneys William Gallion and Shirley Cunningham Jr. defrauded clients of $65 million in Kentucky's 2001 fen-phen settlement.

After the judge declared a mistrial, the jury foreman, Donald Rainone of Erlanger, said jurors were stuck at 10-2 to acquit the defendants, and had been at that vote for much of their deliberations.

"We felt the prosecution just didn't have a strong enough case," Rainone said in a phone interview in which he strongly criticized the prosecution for being unprepared and focusing its case on only Gallion, Cunningham and a third lawyer, Melbourne Mills Jr.

"There's a lot of people that had their hand in this," he said. "There's a lot of people that should have been on trial that weren't."

Rainone declined to say who else should have been on trial, saying he didn't want to "get sued."

Defense attorneys immediately asked that the defendants be released from jail, where they have been since August, pending payment of enormous bonds. Gallion's is set at $52 million and Cunningham's is $45 million.

SCOTUS: Kentucky Retirement System v. EEOC decision hold no discrimination against older workers

SCOTUS decision reported in Herald Leader.  Also, see SCOTUSWiki summary of decision with history, links, and analysis at KRS v. EEOC.

The Supreme Court ruled Thursday that Kentucky's retirement system does not discriminate against older workers.

The court, in a 5-4 ruling, says the retirement system reasonably takes age and length of service into account when structuring benefits for disabled workers who are eligible for retirement.
