CRIMINAL: "Death-row inmate's DNA to be checked against fluids on clothing"

An attorney for Brian Keith Moore, who is on death row for a murder he says he didn't commit, said yesterday that lab technicians have found enough DNA on evidence to potentially eliminate Moore as the killer.

CRIMINAL CASES: Life sentence in ex-sheriff's killing

The man convicted of murdering Harlan County sheriff's candidate Paul L. Browning Jr. must serve at least 25 years in prison, a judge ruled Monday.

The sentence for Raymond Harris of life without the possibility of parole for at least 25 years was less than the jury had recommended. Jurors had said Harris should get life in prison without parole.

But Circuit Judge James L. Bowling Jr. said fairness required that Harris at least have a chance for parole someday.

CRIMINAL: "Fen-phen lawyers appeal bond" HERALD LEADER

Three lawyers who were told last week that they had to come up with more than $100 million in order to get out of jail are appealing their bond amounts.

Lawyers for Melbourne Mills Jr., William Gallion and Shirley Cunningham Jr. filed notice Friday with the federal court in Covington, saying that they plan to ask the U.S. Sixth Circuit Court of Appeals to look at their clients' bond amounts, some of the highest bonds ever set in the federal court in the Eastern District of Kentucky.

CRIMINAL: "Murder trial date set for former Bellarmine student" WAVE3

The woman accused of killing her newborn on the Bellarmine University campus last October will stand trial for murder in September. WAVE 3 has also obtained a copy of the interviews Kathryn McCoy and some fellow students from her dorm did with police hours after McCoy's baby was discovered dead in a gym bag in her room. WAVE 3's Mark Schnyder has gone through the 140 pages of discovery.

Judge sets multimillion-dollar cash bond for Curlin co-owners FROM HERALD LEADER
U.S. District Judge William Bertelsman sealed the opinion Wednesday giving the reason for setting the bond for William Gallion, Shirley Cunningham Jr. and Melbourne Mills.

Bertelsman set bond for Gallion at $52 million and Cunningham at $45 million. The two men own a 20 percent stake in Horse of the Year Curlin. Mills, whose bond was set at $5 million, has no financial interest in the horse.

CRIMINAL: "U.S. Supreme Court rejects mental age case from Kentucky inmate "

A Kentucky death row inmate lost a bid to challenge his death sentence based on mental age after the U.S. Supreme Court declined on Monday to hear the case. Thomas Clyde Bowling, 54, had asked the high court to consider if the ban on executing juveniles extended to people whose mental age was less than 18 years old. The court, without comment, declined to hear the case.
