The nearly 10-year-old conflict made its way to the Kentucky Supreme Court, which on Wednesday reversed a lower court ruling that could have put the case to rest.
Kern's granddaughter, Kentucky resident Linda Kern Cummins, wants the New York attorney who manages the trust, R. Andrew Boose, to be replaced, claiming he had exercised undue influence to become the manager. Boose didn't immediately return a phone call seeking comment Wednesday evening.
Judges at Boyle County circuit court and the Kentucky Court of Appeals had previously sided with Boose who had argued that Kentucky didn't have jurisdiction over issues raised in the 1998 lawsuit. The Supreme Court said Kentucky is the appropriate jurisdiction and ordered the case sent back to Boyle County for further proceedings.
Kern, a two-time Oscar winner who died in 1945, composed music for "Showboat" and for a number of songs popular in the early 1900s.
