Erisa Subrogation: More Government Restrictions in Favor of Insurance Industry

From Tennessee Blog Day on Torts is the following discussion on pending resolution in U.S. House of Representatives which will deprive injured people of their recoveries when hurt from the negligence of others.  Unions should open their eyes to this move which looks like it is favorable to their union funded insurance plans but actually denies and deprives their workers from being made whole when hurt in accidents.  Also, it seeks reimbursement rights against insurance plans (underinsured and uninsured motorist benefits) for which the insurance company has not help pay a penny towards the premium but sits back and wishes to get paid first and off the top before the injured party gets a penny.  click on heading for entire posting.
